Bankruptcy Litigation

Colorado Bankruptcy Litigation Attorney

Colorado Springs citizens do not have to just passively accept the rulings of a bankruptcy trustee. You still have rights and can challenge those rulings or defend yourself against allegations of bankruptcy fraud.

We can defend people accused of:

  • Bankruptcy fraud
  • Maxing out credit cards in anticipation of a bankruptcy filing
  • Hiding assets or intentionally failing to report assets
  • Fraudulently transferring property prior to a bankruptcy filing
  • Other cases involving alleged bankruptcy fraud

We can represent plaintiffs in litigation to:

  • Discharge student loans
  • Discharge taxes
  • Challenge a trustee’s refusal to exempt certain assets
  • Achieve other goals

Experience & Expertise Really Do Matter

Stephen Swift has practiced bankruptcy law for over 30 years. During that time, he has helped countless people throughout Colorado get debt relief and an opportunity to rebuild their finances. His extensive experience and comprehensive knowledge of bankruptcy law enables him to take advantage of many provisions in the law that may escape other attorneys.  In your case, Mr. Swift will aggressively pursue or defend your suit, depending on your goals.

Discharging Student Loans

Generally speaking, students loans are not dischargeable in Colorado bankruptcy. However, there are exceptions. Under the provisions of Section 523 of the Bankruptcy Code, a person must show that they are suffering “undue hardship” in order to obtain a discharge of student loans. Our firm has succeeded in discharging loans for clients in several cases.  If your situation is such that a discharge appears possible, a bankruptcy litigation attorney in our Colorado Springs offices can help initiate the discharge process.  Contact Swift Law Firm today to find out what your options are.
